They had both appeared before the select House committee that looked into the melee in the Capitol caused by Trump fans who believed the former president’s false assertions that he had lost to Biden because of ballot fraud.
Pence has already stated that he will fight Smith’s subpoena for his testimony as former vice president. Also, Mark Meadows, Trump’s ex-chief of staff, was reportedly subpoenaed by Smith in the same investigation.
A representative for the special counsel said they would not comment on the NYT article. When reached for comment by CNBC, neither Ivanka Trump nor Kushner’s lawyers responded quickly.
Smith is also investigating former President Trump for criminal activity in relation to Trump’s removal of White House records upon his departure from office and their subsequent shipment to Trump’s Mar-a-Lago estate in Palm Beach, Florida. Classified information was noted on many of those files.
As reported by the New York Times, Trump’s attorney in that matter, Evan Corcoran, has hired his own attorney and testified in front of a grand jury investigating the matter.
